Danil Hristich

About me

Danil is a Senior Associate at Fortior Law. Prior to joining Fortior, he worked for top-tier Ukrainian shipping law firms. Danil specializes in international trade, shipping and arbitration. For over six years he has been advising oil and grain traders, shipowners, container lines, port agents and freight forwarders.

His experience covers claims handling of disputes under GAFTA and FOSFA pro formas, charterparties and bills of lading. This includes disputes related to non-payment and non-delivery of goods and quality and shortage claims, as well as vessel detention, recovery of demurrage, dispatch, freight, and other sums due.

He also regularly acts on behalf of the parties in international arbitration. In 2019, GAFTA and FOSFA arbitration cases led by Danil were mentioned by The Legal 500 ranking.

Danil is admitted to the bar in Ukraine. He is also an arbitrator of the Caspian Arbitration Society.

Representative experience
  • Representing a Ukrainian grain trader in GAFTA arbitration against Swiss counterparty related to non-payment and partial non-delivery of cargo under instalment deliveries contract;
  • Acting on behalf of major container lines and tramp agents in a dispute worth US$1 million with Ukrainian Sea Ports Authority on challenging of channel dues at Odessa Sea Port;
  • Acting on behalf of a UAE trading company in a FOSFA arbitration dispute with Lebanese buyers of sunflower oil in relation to the quality claim;
  • Advising a commodity trading holding and a France-based bank on trade financing worth over US$40 million;
  • Representing a number of FOB sellers and buyers in disputes on collection of dispatch and demurrage;
  • Advising a Ukrainian grain trader in a dispute connected with forgery of bills of lading and release of the cargo worth over US$1,5 million by container line to the Client;
  • Representing a Swiss commodity trader in GAFTA arbitration in a dispute on the collection of damages under a washout agreement;
  • Advising a CIF seller on cancellation of the charterparty and collection of damages due to vessel arrest by state authorities at Ukrainian seaport;
  • Advising on enforcement of arbitral awards in Czech Republic and Estonia;
  • Acting on behalf of a UAE-based commodity broker in a GAFTA arbitration dispute with a Swiss company on unpaid brokerage fees;
  • Advising a Ukrainian grain trader in relation to a GAFTA contractual / fraud dispute with shipping documents and obtaining of freezing injunctions in High Court.
