Fortior Law (Ukraine) becomes a member of Gafta

We are pleased to announce that Fortior’s Kyiv office has become a member of the Grain and Feed Trade Association (Gafta).

Fortior regularly acts for its clients in Gafta arbitration proceedings and advises on various issues which arise during the performance of contracts.

Our latest cases include:

– a two-tier dispute over partial non-delivery of goods by the Seller under Gafta 78 due to non-payment for the first instalments by the Buyer.

– a dispute on whether a penalty clause is valid and whether it restrains a party from claiming other damages.

– a dispute with a government enterprise of an African country related to a wrongful call on performance bonds.

In late 2020 Fortior established an office in Kyiv, Ukraine – the second largest grain exporter in the world – with an aim to broaden its arbitration practice. The Ukrainian office and Gafta arbitration practice is headed by Danil Hristich. In 2020, Danil was recommended by The Legal500 for his arbitration and dispute resolution experience and capabilities.
