Force majeure cannot be invoked if it could have been overcome
Судовладелец не мог ссылаться на форс-мажор, так как не попытался преодолеть его. Преодолеть форс-мажор можно было, согласившись принять оплату в евро, а не в долларах США (как было предусмотрено чартером). Такое решения вынес Апелляционный Суд по делу MUR Shipping BV v RTI Ltd [2022] EWCA Civ 1406, поддержав решение арбитража LMAA и отменив решение Высокого Суда Лондона.
