Fortior’s client, a Ukrainian coal trader, was subject to a number of negative publications on the internet. The publications alleged that he traded coal with the so-called Donetsk People’s Republic, which the client denied. The publications emanated from a website which pretended to be a newspaper in Switzerland which, upon a brief investigation, turned out to be non-existent. The client then received a demand to pay bitcoin into an anonymous wallet to have the publication removed.
One of the re-publications emanated from a website owned by a Cypriot company and was made via a Cypriot internet service provider. Evripides Hadjinestoros and George Antoniades, both Of-Counsel at Fortior, sought an urgent ex-parte interim injunction at a Cypriot Court. The injunction was granted shortly after their application. Once the injunction was granted and served upon the Cypriot company, it removed the negative article from its website. The Cypriot company did not oppose the injunction.
We then served the injunction on Google and other search engines, demanding the text identical to that covered by the injunction be removed from the search results. Most of the search results were removed. The rest were subject to further proceedings coordinated by Fortior in the US and other jurisdictions.
